My tenant changed the locks and refuses to give me a key. I never go over unannounced but would like a key for emergency purposes. How can I legally get one?

Landlords should ALWAYS have a key to their own properties. Not only for emergency purposes, but if you kick someone out, and they leave you no keys when they are evicted. Send a written letter, both reg and certified mail,to your tenant, stating you want a key by a certain date, and that if they don't comply, you will hire a locksmith to drill out the old lock(s), replace them with new ones, and charge the T for the replacement the next time rent is due. Be sure to mention that the cost will come out of their rent payment FIRST, before the rent gets paid, thereby possibly them owing you rent, in which you will then give them a 3 day notice to pay the rest of the rent, or move.

Check your state's LL/T rules. My state requires the tenant to provide a copy of the changed key to the landlord or the tenancy terminates after a certain time. Your state may have something similar.
Regarding the discrimination claim. Discrimination is when you treat a person differently. Illegal discrimination is when you do that based upon certain protected categories. So just make sure you stay w/in the rules and probably document everything you do with this person. I get the impression that this tenant is claiming that you calling the for the rent when it is late is discriminatory. So, when other tenants are late do you call them too? If you don't then the tenant may be correct.

My lease is very specific. That tenant may NOT change the locks. Period.

I would go over there with someone to witness....change those locks, and bill the tenant for the work...or, send a letter stating that the tenant has NN number of days to put the old locks back or the tenancy will be terminated.

If you do not have such language in your lease...you could have a great deal of trouble getting this fixed. When the lease is up..terminate them.

I do not allow tenants to change locks either.
If they want new locks, we will change them, but we keep a key.
